TERMS OF USE AGREEMENT

 Hello Friends! It would appear that I am growing up a little and becoming more of a real artist. Life is getting busier and messier and I'm trying to streamline things and get all my bases covered. It has come to my attention that I need to have some actual shop policies and legal things in place.  So please forgive the boring stuff in the rest of this post.  It is necessary.  These are my newly updated Terms of Use. You may notice that I have stopped allowing any commercial (for profit) use of my artwork. Thank you all for supporting me and my little Etsy shop over all these years. I love you all!

TERMS OF USE

WHEN YOU PURCHASE ANY ART FROM SUSAN FITCH ILLUSTRATION, YOU ARE PURCHASING AND AGREEING TO A STANDARD LICENSE AGREEMENT. 

A Standard License Agreement includes usage for personal, educational use including religious education. The rights in which the illustrations can be used for each usage according to the Standard License Agreement are listed below.

The license agreement is between the licensor and the licensee and is non-exclusive, non-transferable and non-assignable. The license does not extend to publishers or manufacturers.

 PLEASE BE AWARE THAT BY PURCHASING PRODUCTS FROM SUSAN FITCH ILLUSTRATION, YOU ARE AGREEING TO THESE TERMS OF USE.

Section One: Important Legal Notes
You may not resell, share or distribute the clip art. You may not sell the clip art as a standalone product. The clip art must be used as a design element (part of the overall project design) of your personal projects. A design element is integrated with and compliments text and other design pieces on a page or project to create a new design/material and cannot be the main and/or only component. Furthermore, a design element consists of more than placing a border around an image or placing multiple images on a page.
You may not use the artwork in a platform or program where the artwork is not secured or does not prevent others from taking, lifting, downloading, copying, saving, or removing the images. Additionally, regardless of format, the images may not be loose in any file nor on any platform or program that has not been approved by Susan Fitch Illustration and included under the allowed uses listed in Susan Fitch Illustration’s Standard License. Furthermore, the images cannot be posted, used or displayed in such a way that they can be cataloged or indexed by a search engine.

Susan Fitch illustrations may not be posted on the Internet in any format. Please read more about this under “Disallowed Uses”.

Susan Fitch Illustration retains all copyright to the clip art images. You may not claim the clip art as your own. You may not copy the clip art designs to create your own clip art. You may not use the clip art to create graphic designs or to create graphics-based products.

The permitted uses listed in Susan Fitch Illustration's Standard License Agreement is an exhaustive list of permitted uses.

Upon each purchase of a license it is recommended that you review the license to ensure your desired usage falls in line with the rights and permitted uses listed in this agreement. If the Standard License Agreement does not include a desired permitted usage please contact Susan Fitch Illustration to discuss the possibility of an extended license for your desired use.

You may terminate the agreement by discontinuing past and current use of Susan Fitch illustrations. Failure to comply with the terms of the Standard License Agreement may result in the license being terminated at the sole discretion of Susan Fitch Illustration.

Section Two: Attribution (giving credit and how)

• Commercial credit is required on ALL digital products (free or paid) in the form of a clickable link back to Susan Fitch Illustration’s store. This can be done by creating either a text link or by linking to a logo.
• Commercial credit is required on ALL tangible products where appropriate. Credit to Susan Fitch Illustration in the form of a copyright notice is sufficient.
• Section Three: Personal Allowed Uses (items for personal use that don’t earn a profit)
• Personal Use
• Personal scrapbooking, greeting cards, invitations, calendars, bookmarks, printable projects, personal crafts, flyers, brochures, notices, announcements, t-shirts
• Wedding, birthday, and party items such as party supplies and décor such as cake toppers, wrappers etc.
• Non-profit items for non-profit organizations
• Videos such as on YouTube or Vimeo

 
 
Personal Classroom Use

• Personal classroom activities, printable projects, worksheets, and games.
• If you are creating things that only you will use in your classroom you can skip this step - BUT If you share a file you create with a team member, parent, school, or anyone else, or post on your school page or anywhere online, then all images must be secured in a PDF file with a password that prevents, saving, copying, or lifting the images.
• Personal classroom Smart Board lessons, PowerPoint , SeeSaw -
• If you are creating things that only you will use in your classroom you can skip this step - BUT If you share a file you create with a team member, parent, school, or anyone else, or post on your school page or anywhere online, then the images must be flattened as part of the fixed slide background AND NOT LOOSE - (Whimsy Clips provides a tutorial on How to Create a Flattened Background HERE and how to properly insert the background into the PowerPoint slide HERE )
• Personal classroom use in Google Slides, Google Classroom.

If you are creating things that only you will use in your classroom you can skip this step - BUT If you share a file you create with a team member, parent, school, or anyone else, or post on your school page or anywhere online other than Google Classroom, then the images must flattened as part of the fixed slide background AND not loose in the file.
 

•  Boom Card activities.
•  Personal classroom decorations, wall décor, labels, binder covers, wall posters
•  Progress reports and report cards
•  Classroom or school communication such as letters, newsletters, letterhead, posters, signs, programs, flyers
•  School yearbooks (including yearbooks that are sold to students/families to recover the cost of printing)

Section Four: Commercial Allowed Uses (or entrepreneurs and small businesses who create products to earn a profit – excluding publishers and manufacturers)

No commercial or for profit use is allowed.  If you have specific questions regarding commercial use, please contact Susan Fitch Illustration.
 
Section Five: What is NOT allowed in a Standard License Agreement: (rights that are not included in this license agreement – this is a non-exhaustive list)

Disallowed Uses

• You may not use Susan Fitch illustrations to directly or indirectly infringe on the intellectual property of another party including without limitation copyright, trademark, service mark or other intellectual property
• You may not use the clip art to make political statements or social commentary in any format or medium including without limitation online, social media, or tangible printed formats
• You may not use the clip art in a derogatory or defamatory manner
•  The clip art may not be used as a part of a business logo, trademark, or service mark
•  Standalone Images (isolated graphics) as mentioned in the legal notes above
•  The clip art may not be used as part of a scrapbook kit, embroidery designs, rubber or digital stamps, or SVG cutting files sold for a profit or used for commercial purposes
•  T-shirts, clothing, board games, diaper products, stickers, puppets sold for profit.
•  Digital collage sheets, papers or backgrounds, digital greeting cards, graphics, graphic design, graphics-based products sold for profit.
• Digital website or blog templates, graphic templates, editable templates sold for profit or used for commercial purposes
• iPhone, iPad, Android, Tablet, Facebook or Tiny Tap apps, software design, or embedded in software programs or websites
• You may not recolor or alter the images
• The clip art may not be used in products sold to manufacturers, large corporations or mass-produced including but not limited to published books and workbooks
• Coloring pages are not permitted for commercial purposes.
• The illustrations may not be used to illustrate books sold for a profit
• You may not resell, share or distribute the clip art
• The illustrations may not be used on online presentation sites or print on demand sites of any kind

Additional Terms:

 

• "Non-transferable" as used herein means that except as specifically provided in this Agreement, you may not sell, rent, load, give, sublicense, or otherwise transfer to anyone, the images, the right to modify the images or the right to create their own work with the images. Non-transferrable also means you may not incorporate the clip art images into a product such as to encourage a third party to modify any portion of the product after the third party purchases your product, including but not limited to providing a third party with an editable file containing the clip art images.
• Susan Fitch Illustration reserves the right to update or amend the Standard License Agreement. Susan Fitch Illustration will post a notice on its website when terms are updated. The licensee agrees to be bound by any update to the terms of this license.
• This Agreement shall be construed and interpreted in accordance with the laws of the State of Idaho, which the parties agree shall be the sole and exclusive jurisdiction for any suit or cause of action based upon or arising out of this Agreement. The parties further agree that the venue for any suit or cause of action based upon or arising out of this Agreement shall be Bonneville County, Idaho.
•  If, after the date hereof, any provision of this License Agreement is held by a court of competent jurisdiction to be illegal, invalid or unenforceable under present or future law, the remaining provisions of this agreement shall be fully enforceable.

 
Returns and Refunds Policy

 
As my products are computer files, there really is no way to return a set. However, I am happy to try to find a way to rectify whatever issues may arise.  Please check your purchase as soon as it arrives to assure that the download is successful and complete. I also just finished a new baptism set.  It's kind of an object lesson using printables.  It comes with the whole lesson/talk written out for you.  This is the talk I give any time I'm asked to speak at a baptism.  I've also used it in primary.  It has been a success for me every time.  Last time I used it was in a 4 year old class.  They thought it was magic!  I gave them each their own set to take home and teach their family.  Of course, they also get to eat the pudding cup you use with it.  That's always a bonus.

Plans for the New Year, and a GIVE AWAY!

 

My calling for the past several years has been in the young women.  I've sat through more planning meetings than I can count.  Meetings aren't anybody's favorite thing, but something bright and cute to look at always helps me.  

I just added this new set to my Etsy Shop.  It is a set of planning calendars. The calendars come blank so you can put them together and use them for whatever month you want, and you can use them for years to come.

I always love all the cute little stickers that you can get for planners these days, but I haven't seen any with LDS stuff on them, like going to the temple, or a fireside or something.  I want my church life to be cute too! So, I had a lot of fun making my own stickers for all things LDS.  I guess I shouldn't say all things because there are a lot more that I could have drawn.  But I had to stop somewhere to keep the size of the set manageable for Etsy. Take a look at the Etsy listing and let me know which ones I've missed that you think I definitely need to add. 

You can either build these digitally in the computer, then print them out, or print first and print the pictures onto sticker paper and cut them out before putting them on. I think the Young Women would have fun decorating their own calendars with stickers, but cutting them out would be a lot of work. 

Anyway, I'll be doing a drawing to give away 3 sets of these awesome planning calendars.  I will do the drawing on Saturday January 14. That's a little over a week away. New Testament, new drawings.

 I have a new set in my shop. It's a small collection of New Testament characters.  Many of them can be found in various other sets, but a few of them are new and unique to this set.  That doesn't mean they won't show up in future sets though.  I'm trying to do more New Testament for this year's Come Follow Me curriculum.  I'm not doing a give away for this set, but I am running a promo in my shop.  If you use the promo code BUNDLE on any three sets you can get 20% off.  Let me know if you're really sad that there isn't a giveaway drawing. 

Winter can be hard for me. I tend to lose my mojo. I've mentioned before that I have chronic depression. Having less light in the winter gets to me.  I'm doing fine right now, but I worry that having moved to a colder darker climate, that this year might be harder than usual. I usually hit a big slump more towards February and March.  So, I'm working hard now on a lot of projects in order to keep my serotonin levels up. I often use drawing as a tool for that.  I got a 'therapy lamp' for Christmas and I hope that will help.  I'm also trying to eat healthy, get good sleep and exercise.  Along with medication, all those things help to keep me functional. 

What about you? Does the winter get you down? Or are you like me and have to try to balance mental illness in your life every day?  I've noticed that the amount of sugar I eat has a lot to do with how I feel. What have you found that works (or doesn't) for you?

Are you ready for the holidays? I'm certainly not. I'm not much of a holiday planner. Besides, I've already had my Christmas present. I got to take a bucket-list trip to Ireland a few weeks ago.  My ancestors come from Ireland and I've always wanted to go. It was amazing! I even got to kiss the Blarney Stone.  I was glad to find out that they clean it between each person.  I've always wondered about that. 

 I just finished making this flip chart for Shawna Edwards' song "When We Seek Him". I don't have the copyright for the words, so I couldn't put those on the chart to sell.  However, I did make the pictures to go along with the words and I left room at the bottom of each page so that you can write in the words yourself.  If you have purchased the music to teach it you should be able to make charts and things to help teach it. Because there are other Christmas songs that many of you are teaching, I am also going to make a Christmas edition Flip Chart Buddy set with a random collection of all the artwork I've made that I think you could possibly use in making a flip chart for a Christmas song.  I hope to have that done in the next several days.  If there's something specific you need in a set like that, let me know!

MERRY CHRISTMAS!

Something New

 Hello Friends! I hope you are doing well and staying warm.  Here in Idaho the cold weather came a couple weeks ago and I don't think I've felt warm since.  It's sunk deep down into my bones. It's probably not that bad, but ever since my mission, out tracting in the wet and frigid winter of upstate New York, I have a much lower tolerance for cold weather. It's probably PTSD or something. 

Anyway, I wanted to share with you something new that I'm trying out.

It's Print-On-Demand merchandise.  I just upload my art to their site and they create these nice mock-up pictures that you see here.  Then I can make a listing in my Etsy shop and if anyone chooses to purchase something, the POD company prints it up and ships it out for me. 

Since it's print-on-demand, I don't actually have any samples to send out, so I can't do a drawing or a give-away this time.  But, I thought it would be fun to share with you what I'm doing.  I think they look fabulous.  It makes me feel really fancy to see my artwork on tangible objects. And, THESE WILL MAKE GREAT GIFTS!

I'm not sure if I will do more of this kind of thing or not. (I could make tote bags, clothing, phone cases, fabric, gift wrap, pretty much anything you can think of.)  It depends on whether or not you all seem to like them and want them.  I tried to keep the price as low as I could, but with another company involved in manufacturing and shipping, I don't have much control over that.  They are $9 each. Let me know what you think. Is it worth the cost? Are there other products you'd like to see my art on?

Clip Art of Primary!

 I just finished a new set of Primary clip art.  It's got teachers and choristers, and of course - LOTS of kids! I imagine it being used for flyers about activities, primary programs, and stuff like that.  But I know that there are a lot of you out there who are really creative.  I can't wait to see what you all will use these cute illustrations for.

Last time I asked for your comments about mice and things you are scared of.  I enjoyed your comments so much! I could relate to them all. For some reason I can't comment directly to your comments (maybe I just don't know how?).  But I enjoyed them very much.  The mice saga continues here in the new house. Today - my husband found that mice have been in my CAR!!!! The kids left a bunch of candy in the glove box and the mice have had a field day.  How will I ever drive again?! ugh. 

"Come Follow Me" New set and GIVE AWAY!!!

Well, we did it.  We moved to Idaho. We are slowly but surely settling in and getting used to things. Idaho is a beautiful place.  We love the gorgeous sunrises and sunsets.  We love the cottontail bunnies that run through our yard and the herd of cattle that moos past the back fence every so often.  And the people are so kind and friendly.  

The only thing that I do not like are all the mice and voles around.  I am terrified of mice.  Logically, I know there's no need to be, but when I see one, my body takes over and jumps on the nearest furniture. I was traumatized the other night when one of our cats chased a mouse into my bedroom at around 3 am.  He (the cat) killed the mouse and swallowed it whole right in front of me! While I was relieved that the mouse was taken care of, I was equally disgusted by the sight and sound of the cat choking it down.  My husband sleeping next to me, and my giant dog sleeping on the floor both merely rolled over and went back to sleep.  The particular cat who got the mouse gets a bad wrap at our house because he's grumpy.  But after that, he's been promoted to hero of the house. (in my book, anyway.)  Thank heavens for cats.   Do any of you out there hate mice like I do? 

 

It took me a couple weeks to find where my art supplies had been packed away, but I eventually found them and have started getting back into my groove with drawing.   It's hard to find just the right spot in the house to draw.  I've tried several places, but I think the family room may be the winner.

I just put a new set in my shop.  It's called "Come Follow Me". It's got pictures of the Savior from stories in the Bible, then has illustrations showing modern kids/people doing those same kinds of things.  Baptism, helping the disabled, teaching the gospel, mourning with those who mourn, and feeding the hungry.  And there's one picture of the Savior with his hand out as if to say, "Come Follow Me".  I think the pictures would work well for a flip chart of "I'm trying to be like Jesus" but they aren't specifically drawn for that so they don't necessarily match the words in the song or anything.  

I even remembered to do a line art version so they can be used as coloring pages.

Hooray! I have a new set of clip art in my shop.  I have been so busy the past while.  We bought a house in Ammon, Idaho.  Then we had to scramble to get our house here in Utah on the market and sold.  Now we are in the throws of the end of the school year and are getting ready to move in three weeks.  Oddly, my greatest concern is how to move our two cats when a 3 hour drive is involved. Not to mention keeping cats safe from the coyotes in our new neighborhood. Any tips? 

I had been working on a set of Moses characters, but I just have odd bits and pieces of it.  It needs a lot of work to be a complete set.  So, I decided to put Moses on the back burner for now and I skipped ahead to Joshua.  This set is just the simple story of the Walls of Jericho. Joseph and His Coat of Many Colors

 I have been working on drawing all the stories about Joseph and his coat of many colors.  I was going to just do one big kit, but there are so many different things to draw! I'm running out of time to get it done before we all teach it in primary.  I have enough drawings done for this week's upcoming lesson, (up to the point where he is sold into Egypt) but I'm not quite finished with much after that.  So, I decided just to make smaller kits and get out the drawings I've got for this weeks lesson.  I'll keep drawing and get more of the Joseph stories done for future weeks.

It's been hard to keep up with the Come Follow Me Lessons.  I'm starting to lose steam, but I'm still trying. Wish me luck. I hope you'll enjoy this new set.

Isaac and Jacob

 Hello friends, I've got another new kit in my shop this week.  It is Isaac and Jacob.  I'm trying hard to keep up with the Come Follow Me lessons a little better this year.  

This kit has an older and younger version of Isaac and Rebekah along with the well, Isaac's servant, and camels.  It has Jacob and Esau as kids and grown. It has an angel, Laban, Leah and Rachel, a veiled bride, a small herd of goats, Isaac's favorite dish of spiced meat and the red lentil pottage that Esau traded his birthright for.  It even has a fur coat (not pictured) for Jacob to wear when he poses as Esau.

I've really enjoyed making these kits. I like to listen to Come Follow Me podcasts (among others) while I draw. My favorite one is Follow Him with John Bytheway and Hank Smith.  Drawing all the characters has helped to make better connections in my mind about who is who and what they did.

The last set is Flip Chart Buddy 3. Just like the first two flip chart buddy sets I've done, this one is full of a variety of different clip art to be used for making primary song flip charts.  I've tried to include all the suggestions I've gotten in the last while.

Hello?

 Hello? Is anybody out there? 

I've kind of given up on my blog since blogger stopped sending an email to let you know that I've posted something.  I don't think that people go out of their way to look at blogs anymore. So, this post is kind of an experiment to see if it's worth it for me to keep up my blog.  The biggest problem is that without a blog I don't know how to make freebies available to you. 

If you have any opinions or suggestions about this, please let me know. 

I have thought about getting an actual website, and I've worked on it a little bit, but life is super crazy for me right now and I don't have time for much.

In the meantime, here is a free printable Valentine for you to give to your cute little primary kids at church.  Chrissy at Ministering Printables made it using my artwork.  I think she made it look absolutely adorable.  I hope you'll like it too.

Word of Wisdom kit & FREEBIES

I'm happy to introduce the newest addition to my Etsy shop.  It is a Word of Wisdom printable kit.  It has posters showing the scripture references to each element of the Word of Wisdom - including recent commentary from the prophet.  It has posters of kids who want to eat and kids who don't.  It has a eight pages worth of foods and substances to print out and put on those plates, or in the garbage can.  And it even has a coloring page.  I'm really happy with the way it turned out.  I hope you all will like it too.  There are two posters (shown below) that I decided not to use in the kit. They felt redundant.  Let me introduce you to Icky Nicki who only puts icky things in her body, and Well-Fed-Ned who only puts good things in his body.  If you get the kit from my Etsy shop you can use the foods there to put on these posters, or you could just cut foods out of magazines.  It will be a great way to engage the littles while teaching them about the Word of Wisdom.  

I've decided not to do a drawing for a give-away this time.  Instead, I'm offering Nicky and Ned as freebies to everyone.

It will probably be a while before I put a new kit in the shop.  I've really got to make myself start working on my house and getting it ready to sell.  I would prefer to draw. It's much more fun.  But, I've gotta do what I've gotta do.  What are your best tips for decluttering? 

 

New Girls' Camp Clip Art! (And Give Away!)

I just added this new set into my Etsy shop.  This one, was pure joy.  I did it mostly just for fun - which is good.  Because with all the changes that have been made in the church in the past while, I'm not even sure if girls' camp is still a thing!

The Easter Story and Translation of the Book of Mormon!

 Hello Everybody!  Are you getting excited about the Covid 19 vaccines?  It looks like there may be a light at the end of the tunnel. Hooray! 

I'm excited to announce that I have two new kits in my Etsy shop: 

The first one is kit about the Translation of the Book of Mormon. It has Martin Harris and his wife, Lucy. So you can use it to tell the story of the 116 lost pages.  It also has Professor Charles Anton to tell the story of Martin taking the manuscript to be authenticated.  And best of all, it has EMMA SMITH.  Lots of you have been asking about her.  She hasn't been in any of the other sets I've done so far.  I never draw fast enough to keep up with the pace of the lessons, so I know these stories have already been taught this year, but here they are anyway.  I hope you'll enjoy them.  

The second kit is the Easter story.  I got an email asking if I had illustrations of the Easter story and I thought to myself "Duh! Why have I never thought to do that before?!"  So I sat down and started drawing.  This one IS in time to use for Easter.

The Organization of the Church

 Remember last month when I told you that there would be another collaboration kit coming from me and Chrissy at ministering principles? Well, it's here! 

As a missionary I served at the Peter Whitmer Farm in Fayette, New York.  On April 6, 1830 Joseph Smith and his small group of believers met together there and officially organized the church.  In the visitor's center there, they had three charts showing the organization of the church of Jesus Christ. Each one showing the Savior himself leading the church, with prophets and apostles and the many spiritual gifts that come with the priesthood and authority of God.  One chart showed all this in Christ's time, the next showed it all in the time of Joseph Smith, and the last showed it as it is in current times.  I loved those charts.  Being a visual person it laid things out so clearly and made it so easy to teach that the gospel has been restored now, just as it was in the days of Christ.  

The visitors center in Fayette has been redone since I served there.  They no longer have those charts on the wall.  For years I have been wanting to draw them and have started a few different times over the years.  It never quite happened, until now.  And the timing couldn't be more perfect with the study of church history this year.

As I mentioned, this kit was a collaboration between Chrissy at ministering printables and myself. The kit is HUGE. There are so many things in it. A bingo game with10 cards, a puzzle, bookmarks, posters, a memory game, eye spy cards, treat bag toppers, word search, scripture stickers, fact cards to put in your scriptures, and of course - the charts that started it all.  There is so much stuff in the kit that it's a little pricier than other kits I've put in my shop before.  It's totally worth it.  But, if you don't want to spend the money, you can always enter the drawing here to WIN a set for yourself.
